Australia Terms and Agreement

  1. I understand and agree as follows:
    1. I have represented to Oceaneering International, Inc (the “Company”) that all  information that I have provided as part of this application, including in any resume or other materials I have submitted or in connection with any job interview, are true and complete. Any false or misleading statement, misrepresentation, or omission of fact(s) which it is likely would be material to the Company’s decision to offer employment, in connection with this application may result in the Company withdrawing any offer of employment, or immediate termination of my employment with the Company, regardless of when such false statement, misrepresentation, or omission is discovered.
    2. Any offer of employment I may receive from the Company, or its related bodies corporate (as that term is defined in the Corporations Act 2001(Cth)), is contingent upon completion of the pre-employment screening process and new hire in-processing to the satisfaction of the Company (in its absolute discretion), which may include, but is not limited to, a review of my credit, criminal and employment histories and personal and professional references, as well as completion of any applicable post-job offer pre-employment examination including physical examinations that the Company may require, to its satisfaction. If the results of the screening process and new hire in-processing described above prove unsatisfactory, the Company reserves the right to withdraw any offer and/or terminate my employment with the Company (if commenced) with immediate effect, and without the payment to me of any compensation.
    3. If an offer of employment is made, it may be a condition of this offer (and my ongoing employment) that I undergo and successfully pass a test for alcohol and/or illegal drugs and/or prescribed over-the-counter drugs that may impair my ability to perform my job or may affect the safety or well-being of others from time to time, as directed by the Company and in accordance with the Company’s Drug and Alcohol Policy
  2. Acknowledge and authorize the Company or the Company’s agent, at any time prior to or during my employment, to:
    1. conduct reference checks in relation to my application for employment and/or my employment with the Company and/or its wholly owned subsidiary;
    2. collect my personal information, being information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about me, where my identity is apparent, or can reasonably be ascertained, from the information or opinion (Personal Information);
    3. conduct background checks in relation to my application for employment and/or my employment with the Company and/or its wholly owned subsidiary from time to time, including without limitation (and to the extent permitted by law), searches for any criminal records, employment and education verifications; personal credit history based on reports from any credit bureau; driving history, including any traffic citations; criminal and civil history/records; and any public record;
    4. require me to undergo and successfully pass a test for alcohol and/or illegal drugs, and/or prescribed over-the-counter drugs that may impair my ability to perform my job or may affect the safety or well-being of others in accordance with the Company’s Drug and Alcohol Policy.
    5. store any information (including Personal Information) collected by the Company and/or collection agencies on behalf of the Company, for use in a manner deemed fit by the Company, and to disclose any information (including Personal Information) collected by the Company and/or collection agencies on behalf of the Company, to:
      1. legal and regulatory authorities (such as the Australian Taxation Office), accountants, auditors, lawyers and other outside professional advisers, and companies who provide products and services to the Company (such as IT systems suppliers) (Required Recipients); and
      2. the Company's related bodies corporate (as that term is defined at section 50 of the Corporations Act 2001 (Cth), whether or not that Act applies) to facilitate centralised management of records and other functions.
    6. without limiting 2(e) above, to disclose personal information to related bodies corporate and/or Required Recipients located in another country, including without limitation, including where such country's legislation does not provide the equivalent level of personal data protection as that in force in Australia.
  3. I agree to assist the Company and their nominated collection agencies and their representatives in verifying and collecting any information, including Personal Information, and agree to provide any additional information or authorisation requested in connection with my application for employment with the Company and/or my ongoing employment with the Company.
  4. I agree to provide any information, including Personal Information, reasonably requested by the Company and its collection agencies for the purpose of conduct reference checks and/or background checks.
  5. I permit the Company and its collection agencies to make all necessary enquiries and searches for the purpose of conducting reference checks and/or background checks.
  6. I authorise any person, business entity or governmental agency to disclose information, including Personal Information, to the Company and its collection agencies, including but not limited to any and all courts, public agencies, law enforcement agencies and credit bureaus, regardless of whether such person, business entity or governmental agency compiled the information itself or received it form other sources.
  7. For the avoidance of doubt, any convictions that will be defined as "spent convictions" under applicable Australian law will not be included in the information collected.
  8. I understand that all data will be maintained by the Company and expressly authorise the Company to use, store and disclose such data in any manner they deem fit.
  9.
